Ce document manuscrit atteste que vous êtes propriétaire, mais il peut être approximatif, notamment concernant la surface du bien. Bien qu’il soit courant d’acheter un bien en Melkia entre particuliers marocains, il est recommandé de sécuriser l’achat avec un compromis de vente intégrant une clause suspensive pour l’obtention d’un numéro de réquisition. The requisition number is a step towards obtaining a title deed. It proves that the property is in the process of being titled, which involves precise surveying (cadastre), verification of boundaries with neighbors, and confirmation of the absence of joint ownership. After a legal waiting period (notably allowing heirs to raise objections), a definitive and indisputable title deed is issued. This document is essential for obtaining a bank loan. Today, the process is faster, and a property can usually be titled within about a year. Note: buying an untitled property from a European owner can still be safe if the transaction is well supervised.

In Morocco, the notary plays a central role in every real estate transaction. As a sworn public official, the notary ensures the property’s legal compliance by checking deeds, requisitions, or Melkia. They prepare contracts (preliminary and final deeds), liaise between the parties, the administration, the cadastre, and the land registry. For foreign buyers, the notary can also handle tax settlements (TPI), obtain tax clearance certificates, and facilitate the transfer of funds abroad. Notary fees generally amount to around 1% of the property’s value, in addition to taxes and administrative costs. Thanks to the Franco-Moroccan tax treaty, retirees who are tax residents in Morocco avoid double taxation. To qualify as a resident, one must live in Morocco for more than 183 days a year, own a permanent home there, or have economic interests in the country.
The Moroccan income tax system is progressive, but retirees enjoy significant benefits:

  • A 40% deduction on their pension,
  • Up to 80% additional deduction if the funds are transferred to a non-convertible dirham account.

To benefit, retirees simply need to request that their pension provider (e.g., CNAV in France) transfer payments directly to Morocco.

A lease may be notarized or a private contract that must be legalized. It should include:

  • Identification of the parties
  • Duration of the lease
  • Description and intended use of the property (residential or commercial)
  • Termination conditions and notice period
  • Security deposit (usually one month’s rent)
  • Rent amount and payment terms, with possible adjustment every three years

Registration: Mandatory within 30 days. Fee: 200 MAD.
Inventory of fixtures: Essential to avoid disputes. It must be signed upon move-in and move-out. Without it, the property is assumed to be in good condition. Unpaid rent: In case of default, the landlord may take legal action after issuing a formal notice. If the contract is legally formalized, the process is simplified.
